Der für den Kündigungsschutz zuständige zweite Senat des Bundesarbeitsgerichts hat noch nicht die Frage entschieden, ob mit Leiharbeitnehmern besetzte Dauerarbeitsplätze freie Arbeitsplätze i.S.d. §1 Abs. 2 Satz 2 Nr. 1b Kündigungsschutzgesetz sind. Wäre dies so und hierfür spricht nach der vorgenommenen Analyse der Rechtsprechung zu vergleichbar gelagerten Fällen viel , so wären betriebsbedingte Kündigungen gegenüber Arbeitnehmern der Stammbelegschaft unwirksam, solange Leiharbeitnehmer an Plätzen beschäftigt sind, welche die zu kündigenden Arbeitnehmer aufgrund ihrer Kenntnisse und Fertigkeiten ausfüllen könnten.
