Inwieweit das sogenannte Churning (Spesenschinderei) ein deliktisches Verhalten darstellt, unterzieht die Verfasserin einer eingehenden Würdigung. Dargestellt wird zunächst der Begriff der Spesenschinderei. Es folgt eine kritische Betrachtung der Strafbarkeit dieser Verhaltensweise wegen Betrugs gemäß § 263 Abs. 1 StGB, Untreue nach § 266 Abs. 1 1. und 2. Alt. StGB sowie wegen Verleitung zu Börsenspekulationsgeschäften, §§ 49, 26 BörsG.
