Die Rechtsfähigkeit des Menschen beginnt gemäß Paragraph 1 BGB mit der Vollendung der Geburt. Damit ist noch keine Aussage über die Rechtsfähigkeit des Nasciturus getroffen. Vor dem Hintergrund einer neuen tatsächlichen sowie rechtlichen Normsituation ist der zivilrechtliche Status des Nasciturus neu zu bestimmen. Bereits ab dem Zeitpunkt der Befruchtung in dubio pro vita der Imprägnierung hat der Nasciturus in Bezug auf vermögensrechtliche Rechte ein bedingtes Anwartschaftsrecht. Unabhängig von einer späteren Geburt ist dagegen der Integritätsschutz des Nasciturus. Im Ergebnis ist der Nasciturus beschränkt rechtsfähig und zwar insofern als es ihm zum Vorteil gereicht. In Bezug auf seine vermögensrechtliche Stellung ist er bedingt, im Rahmen des Integritätsschutzes unbedingt rechtsfähig. Da dieses Ergebnis in Bezug auf den Integritätsschutz von der lex lata nicht erfasst wird, kommt insofern lediglich eine Derogation von Paragraph 1 BGB in Betracht.
